Mike Grimley and Ben Zimmern obtained a defense verdict in a slip and fall case that they tried in Panama City, Florida in February. The Plaintiff was recovering from hip surgery when she came into the client’s restaurant on crutches and wearing flip flops. On the way out of the restaurant, the plaintiff slipped and fell. She claimed to have discovered liquid and glass on the floor after her fall, which she attributed to an earlier incident in which a waitress allegedly dropped a tray full of glass mugs. Mike and Ben convinced the jury to find against the Plaintiff by repeatedly impeaching her and her witnesses, and producing numerous witnesses who refuted the claim that a tray had dropped or that there was a foreign substance on the floor. The potential damages were substantial in that the Plaintiff subsequently underwent additional hip surgeries and two hip replacements.
