Bobadilla and Laporte Secure Summary Judgment and Affirmation of Judgment on Appeal for Employer in LA Workers' Compensation Case

Doris Bobadilla and Christie Laporte of the firm’s Mandeville office recently obtained summary judgment on behalf of an employer in a Louisiana workers’ compensation case.

A Claimant alleged two separate work accidents resulted in a Grade V shoulder joint tear. Claimant repeatedly alleged that the work accidents occurred when he carried and rotated pipes on his shoulder. Although Claimant’s treating physician recommended surgery to repair the tear, the physician also opined that the mechanism of injury did not seem to fit the resulting disability. A second medical opinion concurred that the reported mechanism of injury would be highly unlikely.  The Claimant sought additional medical and indemnity benefits from the employer.

On behalf of the employer, Doris and Christie artfully argued Claimant failed to meet the causation element. Galloway Johnson obtained summary judgment. Claimant appealed. Galloway Johnson fought the appeal and the Louisiana Court of Appeal for the First Circuit affirmed the summary judgment. The Employer prevailed.
