Client Wins Summary Judgment in Mississippi Premises Liability Case

Kathryn Breard Platt, in our Gulfport, Mississippi office, was recently awarded summary judgment in a premises liability case on behalf of a fitness club where Plaintiff argued he was injured while using a piece of equipment that malfunctioned causing him injury. The Court found plaintiff did not come forward with any evidence of notice of an unreasonably dangerous condition. The Court further denied plaintiff’s request for additional time to conduct discovery, because plaintiff had not propounded any discovery during the seven months the lawsuit was pending prior to defendant’s motion for summary judgment.
