In a lawsuit arising from a denied homeowner’s insurance claim for hidden decay damage to the plaintiffs’ property, Galloway obtained summary judgment for the insurance carrier on the Friday before trial. Sarah Baggett and Kenneth Hall of our Tampa, Florida office handled the case, successfully arguing that the plaintiffs’ expert testimony regarding continuous decay damage throughout multiple policy periods lacked the scientific foundation required for admissibility. After a lengthy hearing, the trial court determined that our client was entitled to summary judgment on the plaintiffs’ breach of contract claim based on the unrebutted opinions of our expert and the plaintiffs’ lack of evidence to the contrary.
