The plaintiff, a buyer in a real estate transaction, fell victim to nefarious hackers who compromised emails from the selling and closing agents to send fraudulent wire instructions. After wiring nearly half a million dollars to hackers, the plaintiff sought to recover against our client under a theory of negligence. Our attorneys successfully argued that a “Wire Fraud Advisory” contained in the sales contract constituted a valid exculpatory clause shielding our client from liability, and final judgment was entered in our client’s favor.
