In this case, the Plaintiff alleged she was constructively discharged from her employment because the carrier refused to let her go from full-time to part-time due to an alleged disability. Additionally, she alleged that her request to go part-time were denied while men employees’ requests were granted.
The Plaintiff sought $500,000 alleging she suffered discrimination on the basis of race, gender, and disability under Title VII of the Federal Civil Rights Act and the Americans with Disabilities Act. With deep legal knowledge of these federal laws, Galloway argued that the Plaintiff failed to exhaust her administrative remedies on her claims of gender discrimination, disparate treatment, retaliation and hostile work environment. Before a plaintiff may file a lawsuit pursuant to Title VII, they must first file a charge of discrimination with the Equal Employment Opportunity Commission within 180 days of the alleged discriminatory employment practice.
In regards to the Plaintiff’s disability claim, Tujuana and her team argued that the Plaintiff failed to meet the definition of disability under 42 U.S.C. § 12102. The Plaintiff’s Complaint alleges that her qualified disabilities include a fractured right foot, venous thrombosis, varicose veins, and other physical impairments. Our defense was able to establish that not only did her alleged disabilities not qualify under the statute, but prior to the Plaintiff’s return to work from an extended medical leave, she completed a medical examination form and did not report a disability.
