Case Background
The Plaintiffs built a home on Ono Island near Orange Beach, AL and purchased a builder’s risk policy from our client. The application indicated the home was not located on a barrier island, which was false. When our client discovered the misrepresentation, the policy was cancelled.

After the builder’s risk policy was cancelled, the home caught fire and was deemed a total loss. Plaintiffs then filed suit against the insurer, alleging negligence, wantonness, and bad-faith breach of contract.

Nathan and the Galloway team argued that Alabama case law does not recognize a tort for “wrongful cancellation” of insurance, and the client was legally entitled to cancel the policy for material misrepresentation under the terms of the parties’ contract.

The Circuit Court for Baldwin County granted our client’s Motion for Summary Judgment, dismissing the claim.
