“Daily Rate” vs. “Salary Basis” – New Developments Under the Fair Labor Standards Act

Employers in the oil and gas industry might see new FLSA litigation over overtime compensation.  The U.S. Court of Appeals for the Fifth Circuit recently held that an employee who is paid a daily rate is not paid on a “salary basis” under the Fair Labor Standards Act. Hewitt v.
