Doris Bobadilla and John Getty Obtain Dismissal in Construction Injury Case

The United States District Court for the Western District of Louisiana granted a dismissal in favor of Galloway’s client, a subcontractor. Plaintiff asserted that the subcontractor, a former Texas corporation, was responsible for injuries Plaintiff sustained while working at a construction site in Louisiana.  We successfully argued that the Court should apply Texas corporate law to this Louisiana matter.  Under Texas law, we explained that our client was a dissolved corporation and the applicable limitations period for bringing claims against our client had ended.  The Court agreed and dismissed Plaintiff’s claims against Galloway’s client with prejudice.
