This week, Director Les Pickett and Associate Shannon Snider from the Houston office won Summary Judgment in a first-party insurance dispute for our insurance carrier client in the U.S. District Court for the Western District of Texas–Austin Division. Plaintiffs alleged that the client carrier breached the insurance policy and ultimately violated the Texas Deceptive Trade Practices Act and the Texas Insurance Code when the carrier denied coverage for property damage and losses which were not covered by the actual cash value policy. After conducting extensive investigation into the matter, including conducting an examination under oath of the named policy holder, we prepared a Motion for Summary Judgment on behalf of the client showing that the policy clearly did not cover the property damage and losses the Plaintiffs claimed to have suffered. The Court agreed and granted summary judgment in our client’s favor, dismissing Plaintiffs’ case in its entirety.
