Final Summary Judgment Win: Florida Negligence Defense in Pasco County

In this civil lawsuit, the case involved refiled claims arising from the same nucleus of facts as a prior matter that had previously been litigated, though brought by different parties than those in the first lawsuit. In a novel attempt to secure a second ‘bite of the apple,’ personal injury Plaintiffs raised new claims and claims against new parties in an attempt to prolong the litigation and avoid the outcome of the first case.

This tact, if successful, could have had wide reaching implications for Florida law, but Johnson employed a targeted summary judgment strategy grounded in Florida law and the record, successfully arguing that the Plaintiff’s claims were derivative of the underlying action and therefore barred by the doctrines of collateral estoppel and res judicata.

The court agreed, finding that the issues had already been fully litigated and resolved, and granted summary judgment in favor of the defense. The ruling confirms that new parties to the action should not be allowed to pursue derivative claims, or plaintiffs to sue new defendants in perpetuity and draws a firm line in the sand for all litigants.
