Galloway Attorneys Obtain Summary Judgment in Breached Policy Trial

Earlier this month, Galloway attorneys Sarah Baggett and Jordan Grana obtained a summary judgment verdict in a case involving damaged property at a local business after a car crash.

After the plaintiff, a local business owner, failed to comply with their post-loss obligations under their insurance policy and provide a complete inventory of damaged and undamaged goods, the Galloway team successfully drafted and won both a motion to strike the plaintiff’s expert and summary judgment. The case was brought to Judge Moore in the Southern District of Florida and was set to start trial in Miami at the end of the month.

The court placed a significant emphasis on the plaintiff’s failure to comply with the Southern District of Florida’s local rules and file a statement of material facts, which prevented them from meeting their burden to demonstrate a genuine issue of material fact.
