Galloway Director Implements Key Strategies for Win in Florida

In a non-jury trial, Director Edward Krakauer partnered with our insurance carrier in implementing key strategies over three years in a matter that was substantial and significant to our client’s claim handling practices. Galloway Johnson Tompkins Burr & Smith understood the implications and potential consequences to our client’s current and future practices, and once again worked diligently to assist in achieving the carrier’s objectives.

The Plaintiffs challenged whether our client could offer a particular program under their policy of insurance as they alleged the program was not allowed under Florida law. The specific program involves non-catastrophic claims in residential insurance policies whereby contractors are provided by one of the carrier’s outside vendors to effectuate covered repairs under the claim. Previously used for tens of thousands of claims, the program is still in use and currently being administered in ongoing claims.

Edward and the Galloway team implemented key strategies ahead of the trial and collaborated with our client’s appellate counsel on critical elements of the trial. Our client moved for an involuntary dismissal, the equivalent of a directed verdict in a non-jury setting. The judge granted it, finding the Plaintiffs were unable to produce any evidence showing how the MRP was in contravention of any Florida law.

Without this outcome, the carrier’s claims handling practices would have been seriously affected and upended. If the carrier did not prevail during this non-jury trial, thousands of claims and policyholders, if not more, would have had the status of their claims jeopardized.
