Galloway Florida attorneys Sarah Baggett and Anna Kirkpatrick won summary judgment in favor of their client in Florida’s Fifth Judicial Circuit. Sarah and Anna represented the defendant in a negligence case regarding a plaintiff who severed his finger while completing a roof repair at the defendant’s home.
The plaintiff argued that the homeowner was responsible for all damages because he (the plaintiff) was also an employee of the homeowner’s company. Based on the arguments presented on behalf of Galloway’s client, the presiding judge ruled that on the day of the accident, the plaintiff was acting as an independent contractor, not an employee of the defendant’s company, and found Galloway’s client not liable based on the duties owed by a homeowner to a business invitee.
After the counsel for the plaintiff continuously refused to accept anything less than the policy limit of $300,000 at mediation, the judge awarded Galloway summary judgement.
