The Plaintiff sought over $7 million in damages and claimed that Galloway’s client was negligent and produced a defective product by improperly heat treating oilfield production tubing in converting it from J55 grade to P110 grade, and that the allegedly improper heat treating caused the tubing to fail downhole in five wells. Pharr and White argued that our client was hired to convert the tubing under API 5CT specifications and did just that.
Following deliberation, the jury found the Plaintiff 60% at fault, which under the Texas Modified Comparative Fault scheme bars their recovery of any damages.
