Medical Malpractice Case Background
In this matter, Plaintiff filed a request for a medical review panel and associated complaint against Galloway’s client for claims of medical malpractice related to Plaintiff’s medical transport. At the pre-suit medical review panel hearing, O’Connor and Castle obtained a favorable decision. The medical review panel ruled unanimously that Galloway’s client did not breach any standard of care during its treatment of Plaintiff.
Despite the panel’s unanimous opinion, the Plaintiff filed suit. After adequate time for discovery, the Galloway team moved for summary judgment, arguing that Plaintiff’s failure to disclose any expert evidence to rebut the panel’s opinion precluded him from meeting his burden of proof at trial. Agreeing with their argument, the Court granted summary judgment and dismissed all claims against Galloway’s client with prejudice.
