In a bifurcated workers’ compensation trial, Galloway successfully obtained a determination that benefits were not owed by a national trucking company to the claimant. Attorney Jessica Scholl handled the case, arguing both issues of fact related to the claimant’s alleged scope of work as well as an analysis of the multifactorial test to determine whether the company’s truck drivers qualified as employees or as independent contractors under Chapter 440, Florida Statutes. After a lengthy final hearing, the Judge of Compensation Claims ruled in favor of our client, and denied the petition for benefits in its entirety.
