Case Details
Galloway was retained in August 2025, in response to a Complaint filed against its insurance carrier client by the carrier’s insured for breach of contract and bad faith arising out of the denial of coverage on a total fire loss. After some brief discovery, Galloway filed a dispositive motion in the matter in December seeking to void the subject insurance policy based upon misrepresentations by the Plaintiff in the insurance application. After filing the motion, the team endured a hard-fought battle with Plaintiff during back and forth motion practice related to the relief sought before finally getting the matter in front of the Court for a hearing in February 2026.
Galloway’s team persuasively argued the motion at the hearing, and the Court granted Galloway’s motion. The team’s efforts to protect our clients’ business paid off with another favorable outcome.
