Attorney Ben Zimmern from GJTBS’s Pensacola office obtained a defense verdict in Pensacola, Florida where GJTBS’s client was accused of terminating the Plaintiff following Plaintiff’s claim of workers compensation benefits. The defense was able to show that Plaintiff failed to return to work as scheduled and had suffered no damages as a result of the claimed termination. Following three days of trial the jury found that although the Plaintiff suffered an adverse employment action, it was not causally related to Plaintiff’s claim of workers compensation.
