ST. LOUIS, MO: Galloway Johnson’s St. Louis office recently obtained summary judgment in a hotly contested lien priority matter in Jackson County, MO (Kansas City). A judgment lien holder asserted priority to our client’s refinance loan, but firm attorney Brad Anderson successfully applied Missouri’s “replacement theory” to establish priority since our client simply refinanced and satisfied a prior loan held by its predecessor in interest through merger. The fact that the client “stood in the shoes” of the prior lender through merger made for a challenging argument but rewarding result.
MOBILE, AL: John McClurkin of the Firm’s Mobile office recently resolved a disputed access issue in Alabama. The client discovered his property suffered from lack of access to a nearby public road, but John was able to successfully argue the client’s ability to obtain an easement by necessity and prevailed short of trial in the litigation.
