Houston Litigators Secure Arbitration Award in Construction Defect Case

Case Background

In this construction defect case, we represented the general contractor on a new construction on an existing foundation. The home was in a flood zone and had sustained extensive damage following a hurricane. Galloway’s client were contracted to elevate the home and make the conditioned living space on the second floor.

The evidence in this case established that Galloway’s client first breached the contract after receiving a letter from the homeowner about alleged defects when the project was 89% completed. The Claimant attempted to establish that an entire tear down was warranted with alleged damages of $1.3 million. Furthermore, he then alleged that the contractor had violated the Texas Deceptive Trade Practices Act (DTPA) and that he was entitled to treble damages, raising the total ask of the arbitrator to $4 million.

Lambert and Youssef partnered with Galloway’s client and experts in crafting a strategic defense in a week long binding arbitration. They systematically attacked the claimant’s allegations and experts, establishing that the Claimant failed to mitigate his damages by allowing the home to fall in disrepair in addition to addressing every allegation’s merits.

In the end, the arbitrator awarded the Claimant approximately 2% of the claimed damages, representing a considerable outcome in the client’s favor.
