An article examining some of Alabama’s real property laws, authored by John McClurkin, an attorney in Galloway Johnson’s Mobile, Alabama office, was recently published by the American Bar Association in their Title Insurance Litigation Committee Newsletter.
The article focuses on who in Alabama is entitled to excess funds when real property is sold at a tax sale. It explains the historical confusion and inequities of the law which negatively impacted lenders and title insurers, and highlights the recent changes in the law to rectify these issues and protect a mortgage lender’s collateral in Alabama.
