Kathryn Breard Platt of the firm’s Gulfport office recently received an arbitration award in her client’s favor for the full amount claimed in the arbitration, which included interest, attorney’s fees and arbitration costs. Kathryn represented a contractor who built improvements for a homeowner who subsequently refused to pay the balance owed under the contract. The homeowner attempted to avoid payment by arguing he did not “approve” the work, as the contract directed final payment upon approval by the homeowner. The contractor rebutted, showing that the owner tacitly approved the work by failing to complain of any deficiencies.
