Lindsay Meador Young and Benjamin Torian, of the Firm’s Lafayette Office, successfully defended Insurer against the holder of an Owner’s Policy who brought wrongful claims for defense and indemnity based on a boundary line dispute. Summary Judgment was granted in favor of the Insurer after GJTBS accurately defined and argued that the survey exception, a commonly used Schedule B exception, excluded coverage for the claims.
In addition, the Firm’s Lafayette office was successful in its action to reform the legal description of a Mortgage to include two additional tracts of land that the Mortgage failed to describe, but were originally intended to be encumbered. GJTBS utilized the appraisal undertaken in connection with the Mortgage, along with various Acts in the chain of title to prove the intent of the parties to the Mortgage and obtain a favorable Judgment.
