This week, Matthew Williams of the firm’s Gulfport office obtained Summary Judgment in favor of the firm’s client and their insured, a southwest Mississippi timber harvester, in a hotly contested timber trespass case. The Plaintiff alleged that the timber company intentionally trespassed onto her land and knowingly harvested timber without her permission, warranting the imposition of statutory and punitive damages. After extensive investigation into the matter, he prepared a Motion for Summary Judgment on behalf of the client demonstrating that the deed transferring the property to the Plaintiff was void and, even if not void, was executed after the alleged trespass such that the Plaintiff could not maintain an action against the named Defendants. The Court agreed and after extensive arguments, granted summary judgment in favor of our client on the eve of the trial, dismissing the case in its entirety.
