Background
In this real estate case, two divorcees struggled to sell their home with a local realtor, so the divorce judge appointed our client as commissioner to sell the marital home as quickly as practicable and for the “best possible price subject to the approval of the Court.” The couple had originally bought the home for $270,000 and listed it for $370,000 during the divorce, garnering no interest in the market. An offer of $300,000 came, but the ex-wife stated she would not accept anything less than $315,000 for the sale of the house.
After our client was appointed, the plaintiff ex-husband sought to buy the home for $315,000 through a One Time Show and Sell Contract. When the ex-wife refused to sell her interest in the residence to the plaintiff, he accused our client realtor of colluding with the ex-wife to prevent him from doing so. Meanwhile, a potential buyer offered $332,500, even agreeing orally to pay $337,500, but requested the divorcees to pay $7,500 in closing costs. The ex-husband insisted on a counter-offer that would have made the buyer responsible for those costs, which caused the buyer to back out.
A month later, the buyer returned with a lower $326,000 offer. Under pressure from the court, the ex-husband accepted and the sale closed. Nevertheless, he sought to hold our client responsible for “mishandling” the earnest money and selling the residence for an insufficient price.
