Jonathan Minchin and Natalie Daugherty, both of the firm’s Mobile office, recently secured summary judgment on behalf of their clients, an insurance company and its agent, in a negligence and negligent procurement case in the Circuit Court of Winston County, Alabama. The plaintiff claimed that it was not advised to purchase business interruption insurance and, as a result, suffered losses in excess of 2 million following a fire. Judge John Bentley dismissed the plaintiff’s claims with prejudice, holding that neither the insurance company nor its agent owed a duty to the plaintiff, and, even if such a duty was owed, no evidence of breach existed.
