Berenice represents clients in litigation matters in the areas of general liability and casualty defense with an emphasis on commercial and business litigation, multi-party litigation, including cases involving construction defects, creditor’s rights, foreclosure and mortgage litigation, premises liability, medical liability, and insurance coverage and defense.

Berenice has experience litigating large, multi-party construction defect cases on behalf of general contractors and subcontractors ranging from architects, roofers, framers, HVAC subcontractors, and others. Her attention to detail and project management skills allow her to handle the large volume of experts, documents, and discovery that this type of litigation entails, with an eye toward a successful outcome for her client and minimal exposure. Berenice also represents insurance clients in construction defect-related subrogation matters and frequently handles indemnity issues, reviewing agreements and contracts in search of applicable indemnity obligations.

Berenice has been named by Best Lawyers as “One to Watch” in the area of construction law since 2021, which was the inaugural year for this category. She is very involved in her community, and enjoys participating in local bar association activities as well as serving in leadership roles.

  • Successfully assisted in obtaining new trial after default judgment for major mortgage servicing company including representation in subsequent appeals to vacate the default judgment.
  • Assisted in settlement for case involving subcontractor in multi-party construction defects litigation resulting from a fire incident with potential exposure of over $10M, through extensive expert discovery and negotiations successfully reduced client’s liability to 40 percent.
  • Successfully obtained dismissal of subcontractor in multi-party water damage construction defects litigation through dispositive motion based on statute of limitations.
  • Obtained settlement in subrogation construction defects matter with minimal exposure to client.
