In this dram shop case, the decedent’s parents alleged that the driver and decedent visited our client’s bar before the driver crashed their vehicle, causing the decedent’s death. The decedent’s parents sued the local Fort Worth bar. The decedent’s parents failed to prove that the decedent was overserved by the client bar, as required under the Texas Dram Shop Act. Galloway strategically deposed the driver to show that the decedent’s parents could not meet their burden of proof for the claims against our client. Galloway’s motion for summary judgment was granted.
