Galloway’s Client Granted Summary Judgment in Dallas Dram Shop Case

Galloway Johnson Tompkins Burr & Smith secured summary judgment in a dram shop wrongful death case on behalf of our clients, a local bar in Fort Worth, Texas. Mark “Tiger” Pharr, already with a similar outcome in Houston in late 2024, and Berenice Medellin Pruettiangkura worked diligently towards this positive result, delivering client-focused representation that went way above and way beyond.

In this dram shop case, the decedent’s parents alleged that the driver and decedent visited our client’s bar before the driver crashed their vehicle, causing the decedent’s death. The decedent’s parents sued the local Fort Worth bar. Tiger, Berencie, and the Galloway team in Dallas employed key defensive approaches and skills to resolve the case during the summary judgment phase.

The decedent’s parents failed to prove that the decedent was overserved by the client bar, as required under the Texas Dram Shop Act. Galloway strategically deposed the driver to show that the decedent’s parents could not meet their burden of proof for the claims against our client. Galloway’s motion for summary judgment was granted.
