In this case, the Claimants entered into a construction contract with Galloway’s client to build a custom home. After a payment dispute, Galloway’s client stopped work on the home despite additional work being required to complete the home.
During the final arbitration, the Claimants alleged they did not owe further money and were entitled to $1.1 million in damages for alleged construction defects, attorneys fees, arbitration costs and fees plus interest. Additionally, the Claimants asked the arbitrator to find that Galloway’s client violated the Texas Deceptive Trade Practices Act, which would have entitled them to treble damages. By the time the final arbitration hearing and briefing was complete, the total damages exposure was over $3.45 million.
Pharr, Lambert and Saab argued that the Claimants did not meet their burden of proof for a DTPA claim, and the arbitrator ultimately agreed with Galloway’s assessment. Pharr, Lambert and Saab also argued that the Claimants did not meet their burden of proof with the alleged defects, but instead the majority represented “punch list” items that would have been provided by the builder if the Claimants paid the total contract price. The arbitrator again agreed with the arguments and concluded that Galloway’s client owes just 5% of the total demanded.
