Personal Injury Case Background
Galloway’s client, a veterinary clinic, was administering medication to the horse in an unenclosed parking lot when the horse became antsy. The horse’s owner took control of the horse’s bridle in an attempt to calm the horse down by walking it in a circle. The horse became more agitated and began dragging the owner before the horse bolted towards the roadway, which caused the owner to release the bridle.
The horse ran onto a highway and collided with Plaintiff’s vehicle, which resulted in the horse’s death and Plaintiff’s injuries. In the lawsuit, the Plaintiff sought $1 million for the injuries she allegedly sustained.
The Court granted Galloway’s motion for summary judgment, which asserted Texas laws treats veterinary negligence claims the same as medical negligence claims and expert opinions were required to establish the standard of care and breach of same. Additionally, Texas law requires strict adherence to expert report filing deadlines as outlined by the Texas Civil Practice & Remedies Code § 74. When the Plaintiff failed to timely produce the required expert reports, Adraon and Braxton moved for traditional and no evidence summary judgment, which the Court granted.
