Representative Matters

  • Obtained trial victory in a stipulated liability trucking case where Plaintiff was seeking millions of dollars in damages.  Jury awarded Plaintiff less than his actual medical expenses, with no permanent injury and no pain and suffering damages.
  • Obtained final summary judgment for corporate client in premises liability action brought by Plaintiff where the Court found no evidence of actual or constructive notice by Defendant.
  • Created and oversaw global strategy for corporate client defending against mass litigation pursued by assignment of benefits contractors. Resulted in six figure recovery of attorney fees for client either via sanctions or as the prevailing party in dispositive motions and more importantly, a significant slowdown of meritless litigation against the client.
  • Obtained complete defense verdict for our client in a Charlotte County, Florida Trial involving a cast iron/pip trenching case, where the jury decided in our client’s favor – that there was not direct physical loss.
  • Created and oversaw defense strategy for condominium owners being sued for property subrogation claims with no evidence of negligence on the part of the owners. Received more than 40 outright dismissals with no monies paid in favor of the condominium owners as well as significant slowdown of the litigation against the owners.
  • Obtained final summary judgement in favor of a real estate brokerage after the plaintiff, who fell victim to hackers, sought to recover against our client under a theory of negligence. We successfully argued that there was a valid exculpatory clause in a related sales contract that shielded our client from liability.
