SB 47 Background
The bill amended the class action rules to mirror the Federal Rules of Civil Procedure. Federal Rule 23 was last amended and adopted by the Supreme Court in 2018.
Several changes were made to the Missouri rules, including requiring class action certification orders to define the class, claims, issues, and defenses. Class action orders must also contain provisions for appointing class counsel.
Additionally, the rule requires court approval for class actions to be settled, dismissed, or compromised. Consideration will be given to fairness, reasonableness, and adequacy of the settlement or dismissal proposal.
